Términos de uso del sitio
Estos términos regulan el uso de este sitio web. No regulan la compraventa de maquinaria: esa relación se rige por la cotización, el contrato de compraventa y el acta de entrega que se firman en cada operación, documentos que prevalecen sobre este texto en caso de discrepancia.
1Quién opera este sitio
El sitio es operado conjuntamente por las dos empresas del grupo KPA. Cuál de ellas será tu contraparte depende del origen de la operación: las ventas e importaciones hacia el Perú las realiza KPA S.A.C. desde Lima; las adquisiciones y operaciones dentro de Europa las realiza KPA Recycling solutions GmbH desde Viena. Ambas se identifican en el punto 9.
2El catálogo no es una oferta
La maquinaria publicada en este sitio se muestra con fines informativos. La publicación de una máquina, de su descripción o de su precio no constituye una oferta contractual ni obliga a KPA a celebrar la venta: es una invitación a solicitar una cotización.
- Los precios son referenciales, en dólares de los Estados Unidos, sujetos a confirmación, y no incluyen flete, seguro, desaduanaje, traslado ni instalación salvo que se indique expresamente.
- Los precios que se muestran sin impuesto se entienden más IGV cuando la operación se factura en el Perú.
- Toda máquina se ofrece sujeta a venta previa. El stock cambia sin aviso.
- Una operación solo queda cerrada con la cotización aceptada por escrito y el contrato firmado por ambas partes.
3Datos técnicos y fotografías
Las máquinas publicadas son equipos usados. Año de fabricación, contadores de impresiones, configuración y accesorios provienen de la documentación del fabricante, del propietario anterior o del proveedor en origen, y se reproducen de buena fe. KPA no garantiza que esos datos estén libres de error y se reserva el derecho de corregirlos.
Las fotografías identificadas con la etiqueta «Foto referencial» corresponden a una máquina del mismo modelo o familia, no a la unidad ofrecida. Se publican solo para ilustrar el tipo de equipo.
El estado real de cada máquina se verifica en la inspección y en la prueba de funcionamiento previa a la entrega, y se documenta en el acta de entrega. Ninguna descripción publicada en este sitio sustituye esa verificación.
4Uso permitido
Puedes consultar, imprimir y compartir el contenido de este sitio para evaluar la compra de maquinaria o contratar nuestros servicios. No está permitido:
- Reproducir el catálogo, sus fichas o sus fotografías en otro sitio, marketplace o publicación, con o sin fines comerciales, sin autorización escrita de KPA.
- Extraer datos de forma automatizada (scraping, robots, indexación masiva) fuera de los buscadores habituales.
- Usar el formulario o los canales de contacto para envíos publicitarios no solicitados.
- Intentar acceder a partes no públicas del sitio o interferir en su funcionamiento.
5Propiedad intelectual y marcas
Los textos, la estructura del catálogo, el diseño, el logotipo y las fotografías propias de este sitio pertenecen a KPA o se usan con licencia.
Las marcas mencionadas —entre otras Heidelberg, MAN Roland, Ryobi, Polar, Wohlenberg, GUK, Kodak, KBA, Horizon, Shinohara— son propiedad de sus respectivos titulares y se citan únicamente para identificar la maquinaria ofrecida. Su mención no implica que KPA sea representante, distribuidor autorizado ni que exista vínculo, patrocinio o aprobación por parte de esos fabricantes, salvo donde se declare expresamente.
6Disponibilidad del sitio y enlaces
Procuramos que el sitio esté disponible y actualizado, pero no garantizamos su funcionamiento ininterrumpido ni libre de errores. Podemos modificar, suspender o retirar contenidos en cualquier momento.
Los enlaces a sitios de terceros se ofrecen por conveniencia. KPA no controla ni responde por su contenido.
7Responsabilidad
KPA responde por los daños que cause con dolo o culpa inexcusable conforme a la ley aplicable. Fuera de esos supuestos, y en la medida en que la ley lo permita, no asume responsabilidad por decisiones de compra tomadas únicamente sobre la información publicada en este sitio sin la inspección, cotización y contrato correspondientes.
Nada en estos términos limita los derechos que la normativa de protección al consumidor reconozca de forma imperativa.

10Ley aplicable y jurisdicción
Para el uso de este sitio y para las operaciones facturadas por KPA S.A.C., se aplica la ley peruana y las partes se someten a los jueces y tribunales de Lima, con conciliación extrajudicial previa cuando el contrato la prevea.
Para las operaciones facturadas por KPA Recycling solutions GmbH, se aplica el derecho austriaco con exclusión de sus normas de conflicto y de la Convención de las Naciones Unidas sobre Compraventa Internacional de Mercaderías, siendo competente el tribunal materialmente competente de Viena. Frente a consumidores rigen, en todo caso, las protecciones imperativas de su país de residencia.
11Cambios
Podemos actualizar estos términos. La versión vigente es siempre la publicada en esta dirección, con su fecha de actualización. Los contratos ya celebrados se rigen por la versión vigente en la fecha de su firma.

These terms govern the use of this website. They do not govern the sale of machinery: that relationship is governed by the quotation, the sale contract and the handover record signed for each transaction, which prevail over this text in the event of any conflict.
1Who operates this site
The site is operated jointly by the two KPA companies. Which one is your counterparty depends on where the transaction originates: sales and imports into Peru are handled by KPA S.A.C. from Lima; purchases and transactions within Europe are handled by KPA Recycling solutions GmbH from Vienna. Both are identified in section 9.
2The catalog is not an offer
Machinery shown on this site is published for information. Listing a machine, its description or its price does not constitute a contractual offer and does not oblige KPA to sell: it is an invitation to request a quotation.
- Prices are indicative, in US dollars, subject to confirmation, and exclude freight, insurance, customs clearance, transport and installation unless expressly stated.
- Prices shown without tax are understood as plus IGV where the transaction is invoiced in Peru.
- Every machine is offered subject to prior sale. Stock changes without notice.
- A transaction is concluded only once the quotation has been accepted in writing and the contract signed by both parties.
3Technical data and photographs
The machines listed are used equipment. Year of manufacture, impression counters, configuration and accessories come from manufacturer documentation, the previous owner or the supplier at source, and are reproduced in good faith. KPA does not warrant that these figures are free of error and reserves the right to correct them.
Photographs marked "Reference photo" show a machine of the same model or family and not the unit being offered. They are published only to illustrate the type of equipment.
The actual condition of each machine is established at inspection and at the test run prior to handover, and recorded in the handover document. No description published on this site replaces that verification.
4Permitted use
You may consult, print and share the content of this site in order to evaluate a machinery purchase or engage our services. You may not:
- Reproduce the catalog, its data sheets or its photographs on another site, marketplace or publication, commercially or otherwise, without KPA's written permission.
- Extract data by automated means (scraping, bots, bulk indexing) beyond ordinary search engines.
- Use the form or contact channels for unsolicited advertising.
- Attempt to access non-public parts of the site or interfere with its operation.
5Intellectual property and trademarks
The texts, catalog structure, design, logo and KPA's own photographs on this site belong to KPA or are used under licence.

6Availability and links
We aim to keep the site available and up to date, but we do not warrant uninterrupted or error-free operation. We may modify, suspend or withdraw content at any time.
Links to third-party sites are provided for convenience. KPA does not control and is not responsible for their content.
7Liability
KPA is liable for damage caused by intent or gross negligence under the applicable law. Beyond those cases, and to the extent permitted by law, KPA accepts no liability for purchasing decisions taken solely on the information published here without the corresponding inspection, quotation and contract.
Nothing in these terms limits rights granted mandatorily by consumer protection law.

10Governing law and jurisdiction
For the use of this site and for transactions invoiced by KPA S.A.C., Peruvian law applies and the parties submit to the courts of Lima, with prior out-of-court conciliation where the contract provides for it.
For transactions invoiced by KPA Recycling solutions GmbH, Austrian law applies to the exclusion of its conflict-of-law rules and of the UN Convention on Contracts for the International Sale of Goods, and the competent court in Vienna has jurisdiction. In dealings with consumers, the mandatory protections of their country of residence apply in any event.
11Changes
We may update these terms. The version in force is always the one published at this address, with its update date. Contracts already concluded are governed by the version in force on the date they were signed.

1Betreiber dieser Website
Die Website wird gemeinsam von den beiden KPA-Gesellschaften betrieben. Wer Ihr Vertragspartner ist, richtet sich nach dem Ursprung des Geschäfts: Verkäufe und Importe nach Peru wickelt die KPA S.A.C. in Lima ab; Ankäufe und Geschäfte innerhalb Europas die KPA Recycling solutions GmbH in Wien. Beide sind unter Punkt 9 angeführt.
2Der Katalog ist kein Angebot
Die hier gezeigten Maschinen dienen der Information. Die Darstellung einer Maschine, ihrer Beschreibung oder ihres Preises ist kein verbindliches Vertragsangebot und verpflichtet KPA nicht zum Verkauf, sondern ist eine Einladung zur Angebotsanfrage (invitatio ad offerendum).
- Preise sind Richtpreise in US-Dollar, Bestätigung vorbehalten, und verstehen sich ohne Fracht, Versicherung, Verzollung, Transport und Montage, sofern nicht ausdrücklich anders angegeben.
- Ohne Steuer ausgewiesene Preise verstehen sich zuzüglich IGV, soweit in Peru fakturiert wird.
- Alle Maschinen stehen unter Vorbehalt des Zwischenverkaufs. Der Bestand ändert sich ohne Ankündigung.
- Ein Geschäft kommt erst mit schriftlich angenommenem Angebot und beiderseits unterzeichnetem Vertrag zustande.
3Technische Angaben und Fotos
Die angebotenen Maschinen sind Gebrauchtmaschinen. Baujahr, Bogenzähler, Ausstattung und Zubehör stammen aus Herstellerunterlagen, vom Vorbesitzer oder vom Lieferanten am Ursprungsort und werden nach bestem Wissen wiedergegeben. KPA übernimmt keine Gewähr für die Fehlerfreiheit dieser Angaben und behält sich Korrekturen vor.
Mit „Referenzfoto" gekennzeichnete Bilder zeigen eine Maschine desselben Modells bzw. derselben Baureihe und nicht die angebotene Einheit. Sie dienen ausschließlich der Veranschaulichung des Maschinentyps.
Der tatsächliche Zustand jeder Maschine wird bei der Besichtigung und beim Probelauf vor der Übergabe festgestellt und im Übergabeprotokoll dokumentiert. Keine auf dieser Website veröffentlichte Beschreibung ersetzt diese Prüfung.
4Zulässige Nutzung
Sie dürfen die Inhalte dieser Website abrufen, ausdrucken und weitergeben, um einen Maschinenkauf zu prüfen oder unsere Leistungen zu beauftragen. Nicht gestattet ist:

10Anwendbares Recht und Gerichtsstand
Für die Nutzung dieser Website und für Geschäfte, die von der KPA S.A.C. fakturiert werden, gilt peruanisches Recht; Gerichtsstand sind die Gerichte in Lima, mit vorgeschalteter außergerichtlicher Schlichtung, soweit der Vertrag dies vorsieht.
Für Geschäfte, die von der KPA Recycling solutions GmbH fakturiert werden, gilt österreichisches Recht unter Ausschluss seiner Verweisungsnormen und des UN-Kaufrechts; zuständig ist das sachlich zuständige Gericht in Wien. Wir können diese Bedingungen aktualisieren. Maßgeblich ist stets die unter dieser Adresse veröffentlichte Fassung mit ihrem Stand. Bereits geschlossene Verträge richten sich nach der zum Zeitpunkt der Unterzeichnung geltenden Fassung.
